• Technical data: your IP address, device and browser type, pages viewed, time spent, the advertisement or search that brought you here (including click identifiers), and cookie or similar identifiers.
• Any other information you choose to give us.

2. How we collect it

We collect personal data directly from you through forms, WhatsApp, phone calls, email and visits to our premises. We also collect technical data automatically through cookies and similar technologies when you use the Website, and we may receive data from our advertising and analytics service providers.

3. Why we use your personal data

• to respond to your enquiry and prepare quotations;

• to establish, exercise or defend legal claims.

4. Consent and your choices

We process your personal data with your consent or, where the PDPA allows, because it is needed to take steps at your request before a contract, to perform a contract or to comply with the law. Giving us your personal data is voluntary. If you do not give us the data we ask for, we may not be able to respond to your enquiry, give you a quotation, deliver your order or provide after sales support.

You may withdraw your consent at any time by contacting us as set out in section 11, but this may affect our ability to serve you. We will use your personal data for direct marketing only with your consent or as otherwise allowed by law, and you can ask us to stop at any time.

5. Who we share your personal data with

We do not sell your personal data. We may disclose it to:

• service providers that help us run the Website and our business, including website and landing page hosting, analytics, advertising and messaging platforms, and our digital marketing providers;
• couriers and logistics companies, to deliver your order;
• banks and payment service providers, to process and verify payments;
• our professional advisers, such as accountants, auditors and lawyers;
• government, regulatory and law enforcement authorities, where the law requires it; and
• a buyer or successor, if our business is sold or restructured.

We require our service providers to protect your personal data and to use it only for the purposes we give them.

6. Transfers outside Malaysia

Some of our service providers, such as Google, Meta (WhatsApp) and our landing page platform, may store or process data on servers outside Malaysia. Where we transfer your personal data outside Malaysia, we do so as the PDPA permits, for example to places with laws substantially similar to the PDPA or that give an equivalent level of protection, and we take reasonable steps to protect it. By giving us your personal data, you agree to these transfers.

7. Cookies and tracking

The Website may use cookies, pixels, tags and similar technologies, including Google Ads, Google Analytics and Google Tag Manager, to understand how visitors use the Website, to measure the results of our advertising and to improve our service. We record actions such as clicking a WhatsApp button or a directions button and submitting a form.

You can block or delete cookies in your browser settings, and you can manage Google advertising settings at https://adssettings.google.com. Blocking cookies may affect how the Website works.

8. Third party services

The Website links to or embeds services we do not control, including WhatsApp, Google Maps and Waze. Their own terms and privacy policies apply when you use them. When you message us on WhatsApp, WhatsApp's terms and privacy policy apply to that conversation, and we cannot control how WhatsApp handles it.

9. How long we keep your personal data

We keep personal data only for as long as we need it for the purposes in this policy and as the law requires. Business, accounting and tax records are generally kept for seven years, in line with Malaysian law. Enquiries that do not lead to an order are kept for as long as reasonably needed to follow up and to handle any dispute, and are then deleted or anonymised.

10. Security and payment fraud

We take practical steps to protect personal data from loss, misuse, unauthorised access, disclosure, alteration and destruction. No online transmission or storage is completely secure, so we cannot guarantee absolute security. If a personal data breach occurs, we will notify the authorities and affected individuals as the PDPA requires.

Please be careful about payment fraud. We will only ask you to pay into our official company bank account, which is shown in our quotation and on the Website. Do not transfer money to any other account, even if the request appears to come from us.

11. Your rights and how to contact us

Subject to the PDPA, you may ask us to give you access to your personal data, to correct it, to stop or limit its processing (including for direct marketing), and to withdraw your consent. Where it applies and is technically feasible, you may also ask us to transfer your personal data to another data controller in a structured format (data portability).

To make a request, contact us using the details in section 14. We may need to verify your identity first, and we may charge a fee that the PDPA permits. We will respond within the time the PDPA requires, which is generally 21 days for access and correction requests. We may refuse a request where the PDPA allows.

12. Children

The Website is for businesses and adults. We do not knowingly collect personal data from anyone under 18. If you believe a child has given us personal data, please contact us and we will delete it.

These Terms of Use ("Terms") govern your use of https://www.hogansmalaysia.com (the "Website"), which is operated by Hogans Enterprise Sdn. Bhd. (Registration No. 1006130D/201201021638) ("Hogans", "we", "us" or "our"), and your enquiries, quotations and orders with us. Please read them together with our Privacy Policy. By using the Website, requesting a quotation or placing an order, you accept these Terms. If you do not accept them, please do not use the Website.

1. About the Website

The Website gives information about the truck and lorry parts we supply and lets you contact us. It is not an online shop and you cannot buy on the Website. Quotations and orders are handled through WhatsApp, phone or email and are subject to section 5.

2. Independent seller and trademarks

Scania and Volvo names referenced on this website are used solely for part compatibility identification. HOGANS ENTERPRISE SDN. BHD. is an independent seller of OEM equivalent parts and is not an authorized dealer or distributor of Scania or Volvo. No affiliation or endorsement is implied.

Scania, Volvo and all related names, logos and trademarks belong to their respective owners. We sell new OEM equivalent parts and we do not supply used parts. Unless we state in writing in your quotation or invoice that a part is genuine, you should not treat any part as a genuine Scania or Volvo part. We supply parts for trucks and lorries only, not for buses.

3. Information on the Website

We try to keep the information on the Website accurate, but we do not promise that it is complete, current or free of errors. Photos, descriptions and the vehicle models and series we list are for general guidance. A part that looks the same in a photo may differ in size, fitting or specification. Always confirm compatibility with us before you order.

4. Compatibility and the information you give us

You are responsible for giving us correct and complete information, including the vehicle model, year, chassis or VIN number, part number and quantity. We use that information to recommend a part. We are not responsible for a part that does not fit because the information you gave us was wrong or incomplete, or because you chose a part other than the one we recommended. Please compare the part with your old part before installation, and have it installed by a competent workshop.

5. Quotations and orders

Nothing on the Website is an offer to sell. A quotation is an invitation to order and not a binding offer. Each quotation is valid for the period stated in it. If no period is stated, it is valid only until we tell you otherwise. Prices and availability may change until we confirm your order.

An order is accepted only when we confirm it in writing, which includes a WhatsApp message, and we have received your payment in cleared funds. We may refuse or cancel an order, for example because of a stock shortage, a price or description error, suspected fraud or inability to deliver. If we cancel an order, we will refund any amount you paid for it.

6. Prices and payment

Prices are in Malaysian Ringgit (RM) unless stated otherwise and are as stated in your quotation or invoice. Taxes, delivery and other charges are shown in the quotation or invoice where they apply.

We accept payment by bank transfer to our official company bank account only. The current bank details are shown on the Website and in your quotation. Do not pay into any other account. We are not responsible for any payment made to an account that is not our official account, or for scams that pretend to be us. We release goods after we receive cleared funds and your bank receipt.

7. Delivery and collection

We deliver to the home address or workshop in Malaysia that you give us, and we provide a tracking number where available. Delivery times are estimates only. To the extent the law allows, we are not liable for delays caused by couriers, weather, stock availability or events outside our control.

You may also collect your parts at our premises in Batu Caves on a cash and carry basis after we confirm your order. Risk in the goods passes to you when they are delivered to you or collected, and ownership passes to you when we receive full payment. Please check your parcel when you receive it and tell us promptly about any damage, shortage or error.

8. Returns, exchanges and warranty

Returns, exchanges and warranty terms are those stated in your quotation or invoice, or that we confirm to you in writing. Unless the law or those terms say otherwise, we do not accept the return of parts that have been installed, used, modified, damaged or that are not in their original condition and packaging, and a warranty does not cover wear and tear, misuse, accidents, incorrect installation, lack of maintenance, modification or use outside normal operating conditions.

Where a part is faulty or not as described, our responsibility is limited to the repair, replacement or refund of that part, at our choice, to the extent the law allows. Nothing in these Terms affects your rights under the Consumer Protection Act 1999 where it applies to you.

9. Your use of the Website

You agree to use the Website lawfully. You must not:

• submit false, misleading or automated enquiries, or use bots or scripts on the Website;
• click on or interact with our advertisements dishonestly or in a way that harms our advertising;
• copy, scrape or extract content from the Website without our written permission;
• try to gain unauthorised access to, or interfere with, the Website or its security;
• upload harmful code or use the Website to send spam.

We may block access, report misuse to the authorities and recover any loss that misuse causes us.

10. Intellectual property

The content of the Website, including text, photos, graphics, logo, layout and design, belongs to us or our licensors and is protected by law. You may view and print pages for your own use in dealing with us, but you may not copy, republish, sell or modify any content without our written permission. Third party names and logos belong to their owners.

11. Contacting you

When you send us an enquiry, you agree that we may contact you by WhatsApp, phone or email about it. Our Privacy Policy explains how we handle your personal data.

12. Third party links and services

The Website may link to or embed services we do not control, such as WhatsApp, Google Maps and Waze. We are not responsible for those services, and their own terms apply when you use them.

13. Disclaimer

To the fullest extent permitted by law, the Website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not promise that the Website will be uninterrupted, secure or free of errors or viruses.

14. Limitation of liability

To the fullest extent permitted by law, Hogans and its directors, employees and agents are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business, goodwill or vehicle downtime, arising from your use of the Website or any part we supply. Our total liability to you for any claim relating to a part or an order is limited to the price you paid for that part.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.

15. Indemnity

To the extent the law allows, you agree to compensate us for any loss, claim or cost we suffer because you breach these Terms, give us incorrect information or misuse the Website.

16. Events beyond our control

We are not in breach of these Terms and are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, strikes, supplier or courier failure, government action, power or internet failure and cyber attacks.

17. Changes

We may change these Terms, the Website and our prices, products and services at any time without notice. The updated Terms apply from the date shown at the top of this page. If you keep using the Website, you accept them.

18. General

If any part of these Terms is found to be invalid, the rest stays in force. If we do not enforce a right, that is not a waiver of it. These Terms, together with your quotation or invoice and our Privacy Policy, are the whole agreement on their subject. If a quotation or invoice conflicts with these Terms, the quotation or invoice applies to that order. You may not transfer your rights under these Terms without our written consent.

19. Governing law and disputes

These Terms are governed by the laws of Malaysia. Please contact us first so that we can try to resolve any concern. Any dispute is subject to the exclusive jurisdiction of the courts of Malaysia.
